Using our services means you accept Weiss Air Conditioning and Plumbing’s Terms.

Our Policies & Terms

WEISS AIR CONDITIONING & PLUMBING

Effective Date: 01/01/2026


1. Terms of Payment

Payment is due in full at the time of service unless otherwise agreed to in writing. A late fee of 10% per month may be applied to all past-due balances. Returned or declined payments incur a $35 processing fee. Weiss Air Conditioning & Plumbing reserves the right to suspend or stop work immediately for non-payment. Customers agree to be responsible for all reasonable costs incurred in collecting unpaid balances, including administrative fees, collection costs, arbitration fees, court costs, and attorneys’ fees as allowed by law.

2. Financing & Payment Plans

Third-party financing is subject to credit approval and is arranged between the customer and the lending institution. Weiss Air Conditioning & Plumbing is not a party to the financing agreement and assumes no responsibility for approval, denial, terms, interest rates, or collection. If financing is denied after work has commenced, payment in full is immediately due via alternative means. Promotional financing terms are subject to change without notice and must be confirmed at time of application. Customers are responsible for understanding all financing terms, including deferred interest provisions.

3. Scope of Work

All work is limited strictly to the labor, materials, equipment, and services described in the approved estimate, invoice, service agreement, or work order. Any repairs, upgrades, or modifications not expressly included are excluded. Declined recommendations are performed at the customer’s own risk. Estimated completion dates are projections only and are not guaranteed.

4. Estimate Accuracy & Hidden Conditions

Estimates are based on visible and accessible conditions at the time of inspection and assume standard working conditions. Pricing may change if hidden conditions are discovered including concealed damage, code violations, structural issues, hazardous materials, inadequate utilities, or other unforeseen complications. Customers will be notified of additional costs before proceeding, and authorization will be required for additional work. Final invoices may vary from estimates based on actual conditions encountered and materials used. Time-and-material work is billed at actual hours and materials plus applicable markup.

5. Estimate Validity & Material Price Volatility

Estimates are valid for 14 days unless otherwise stated. Pricing may change due to material cost increases, refrigerant pricing, manufacturer adjustments, or scope changes occurring after the estimate expiration.

6. Seasonal Pricing & Material Cost Volatility

Service rates and material costs are subject to change based on market conditions, manufacturer price increases, supply chain disruptions, refrigerant costs, metal pricing, and seasonal demand. Pricing during peak seasons (summer cooling, winter heating) may be higher due to increased demand and longer lead times. Estimates are valid for 14 days; pricing beyond the expiration date is subject to adjustment. Equipment pricing is confirmed at the time of order placement and is subject to manufacturer availability and pricing in effect at that time.

7. Additional Repairs & Change Orders

If additional issues are discovered during service, a separate estimate or change order will be provided. Authorization may be given verbally, electronically, or in writing and constitutes approval to proceed. If additional work is declined, the customer remains responsible for all work performed to date. Claims related to completed work must be reported within 30 days.

SCHEDULING & SERVICE POLICIES

8. Cancellation, Rescheduling & No-Show Policy

Cancellations or rescheduling requests must be made at least 24 hours before the scheduled appointment. Same-day cancellations, no-shows, or denied access after technician dispatch are subject to a service call fee equal to the standard diagnostic charge. This fee covers dispatch costs, scheduling disruption, and lost opportunity. Emergency appointments canceled within 2 hours of arrival window are subject to the full emergency service rate. Repeated cancellations may result in prepayment requirements for future service.

9. Diagnostic, Service Call & Trip Charges

A standard diagnostic fee applies to all service calls and covers the technician’s visit, inspection, and diagnosis of the issue. This fee is charged regardless of whether repairs are authorized and is non-refundable. Diagnostic fees may be credited toward approved repairs completed the same day at the technician’s discretion and company policy. Emergency, after-hours, weekend, and holiday service calls incur premium diagnostic rates. Service call minimums apply to all visits. Trip charges may apply for properties outside our standard service area.

10. Service Area & Travel Charges

Our standard service area includes Montgomery County, Texas and immediately surrounding communities. Service calls outside this area are subject to additional travel charges based on distance and drive time. Travel fees will be disclosed prior to scheduling and are in addition to diagnostic and service charges. Availability for out-of-area service is not guaranteed and is subject to scheduling constraints.

11. Emergency Service Terms & Pricing

Emergency service is defined as situations presenting immediate risk of property damage, loss of essential utilities (heating/cooling during extreme weather, loss of water or sewer service), or conditions requiring urgent response for safety or habitability. Emergency services are available 24/7 and are subject to premium pricing, typically 1.5 to 2 times standard rates, depending on time of day, day of week, and weather conditions. Holiday emergency rates may be higher. Emergency service does not guarantee specific response times, as availability depends on weather, technician location, and current call volume. Non-emergency issues presented as emergencies may be reclassified upon arrival, but emergency rates will still apply if service is performed outside normal business hours.

12. Return Visits / Callbacks

Diagnostic or service fees apply for follow-up visits resulting from unrelated issues, customer misuse, blocked access, power or utility issues, or pre-existing conditions. Scheduling is subject to availability.

13. Weather Delays & Outdoor Work Limitations

Outdoor installation, rooftop work, concrete work, and certain plumbing excavations cannot be safely performed during inclement weather including rain, high winds, extreme temperatures, lightning, or icy conditions. Scheduled outdoor work may be rescheduled due to weather without penalty to either party. Extended weather delays are beyond our control and do not constitute breach of contract. Indoor work may proceed during weather delays when safe and practical.

PROPERTY ACCESS & CUSTOMER RESPONSIBILITIES

14. Access to Property

The customer must provide safe, clear, and uninterrupted access to all equipment, utilities, and work areas. Delays caused by restricted access, pets, occupants, or site conditions may result in additional charges. After-hours, emergency, or restricted-access visits—including warranty visits—may incur additional fees.

15. Customer Responsibilities

The customer agrees to provide accurate system history, timely approvals, safe working conditions, and to keep children and pets away from work areas. Failure to do so may result in delays or additional charges.

16. Property Damage

Reasonable care will be taken during service; however, Weiss Air Conditioning & Plumbing is not responsible for incidental or cosmetic damage unless caused by gross negligence. Some access may require cutting, drilling, or modifying walls, ceilings, floors, ductwork, or piping. Restoration of finishes is the customer’s responsibility unless otherwise stated in writing.

17. Structural & Property Condition Exclusions

Weiss Air Conditioning & Plumbing is not responsible for pre-existing structural issues, foundation problems, settling, soil conditions, drainage issues, grading problems, or structural defects that affect plumbing or HVAC systems. Services are provided based on visible and accessible conditions at the time of installation or repair. Damage to property caused by pre-existing structural issues, concealed defects, or conditions beyond normal wear and tear is not our responsibility. Significant structural repairs required to complete work are excluded from standard pricing and require separate agreement.

WARRANTIES & EQUIPMENT

18. Warranty Coverage

Unless otherwise stated in writing, Weiss Air Conditioning & Plumbing provides a one-year parts-only warranty. Labor, diagnostics, refrigerant, shipping, and administrative costs are excluded. Warranty coverage is void if equipment is altered, misused, neglected, improperly maintained, or serviced by unauthorized parties. Warranties are non-transferable.

19. Manufacturer Warranties

Any assignable manufacturer warranties are passed through to the customer. Warranty approval is solely at the manufacturer’s discretion. If a claim is denied, the customer is responsible for all associated repair costs, including labor and materials.

20. Equipment Age, Obsolescence & Parts Availability

Weiss Air Conditioning & Plumbing makes reasonable efforts to obtain replacement parts for existing equipment; however, parts availability for systems over 15 years old or discontinued models is not guaranteed. Manufacturers discontinue parts, change designs, and phase out product lines regularly. If parts are unavailable, system replacement may be the only option. We do not guarantee compatibility of new parts with older systems or the availability of exact-match components. Customers are advised that repair of aging systems may not be cost-effective and carries risk of repeat failures.

21. Equipment Disposal & Haul-Away

Unless specifically included in the written estimate, removal and disposal of old equipment is the customer’s responsibility. Haul-away services are available for an additional fee. Environmental disposal fees apply to equipment containing refrigerants, oils, or other regulated substances and are subject to current market rates and EPA regulations. Customers who elect to keep old equipment must remove it from the work area prior to installation. Any equipment left on-site after 48 hours becomes the property of Weiss Air Conditioning & Plumbing and may be disposed of at the customer’s expense.

22. Title & Ownership of Installed Equipment

All equipment, materials, and fixtures installed remain the property of Weiss Air Conditioning & Plumbing until paid in full. Upon full payment, title transfers to the customer. If payment is not received, Weiss Air Conditioning & Plumbing reserves the right to remove installed equipment to the extent permitted by law and subject to lien rights. Removal costs will be charged to the customer.

23. Environmental & Recovery Fees

Fees related to refrigerant recovery, disposal, environmental compliance, or hazardous material handling are additional and subject to market pricing and regulatory requirements.

HVAC-SPECIFIC TERMS

24. HVAC Licensing & Mold Disclaimer

HVAC services are performed under Texas Air Conditioning and Refrigeration (ACR) Contractor License TACLA73401C. Technicians may hold EPA certifications. Weiss Air Conditioning & Plumbing is not licensed for mold assessment or remediation. Any observations regarding mold are non-professional opinions only. Customers are advised to consult a licensed mold professional.

25. Refrigerant Regulations & Pricing

All refrigerant handling is performed in accordance with EPA Section 608 regulations by EPA-certified technicians. Refrigerant prices fluctuate based on market conditions, regulatory changes, and manufacturer availability. Older refrigerants (R-22, R-410A phase-out) are subject to limited availability and premium pricing. Recovery, recycling, and disposal of refrigerants are charged separately and are subject to EPA requirements. System conversions from obsolete refrigerants may require additional components and labor. Refrigerant pricing in estimates is subject to change based on market conditions at time of service.

26. HVAC System Sizing & Ductwork

Weiss Air Conditioning & Plumbing is not responsible for the adequacy or condition of existing ductwork, system sizing, or air distribution unless specifically included in the scope of work. Replacement equipment is sized to match existing equipment or is calculated based on industry-standard load calculations when performed. Poor air distribution, inadequate ductwork, or improperly sized existing systems may affect new equipment performance. Duct modifications, sealing, insulation, and balancing are additional services and are not included in standard equipment replacement unless specified in writing. Existing ductwork may contain asbestos or other hazardous materials; identification and remediation are the customer’s responsibility.

27. Indoor Air Quality Products & Limitations

Indoor air quality (IAQ) products including UV lights, air purifiers, humidifiers, dehumidifiers, and media filters are designed to improve air quality but do not guarantee elimination of allergens, viruses, bacteria, mold, or odors. Performance depends on proper installation, regular maintenance, environmental conditions, and occupant behavior. IAQ products require regular maintenance including filter changes, UV bulb replacement, and cleaning, which are the customer’s responsibility. Failure to maintain IAQ equipment voids all warranties. IAQ products do not replace proper ventilation, source control, or professional remediation of mold or other contaminants.

28. Electrical Work Scope & Limitations

HVAC-related electrical work performed under our ACR license includes low-voltage wiring (thermostats, controls), equipment disconnect installation, and connections to existing circuits sized for HVAC equipment. Major electrical work, panel upgrades, circuit additions, or repair of existing electrical defects require a licensed electrician and are not included unless specifically stated in writing. Weiss Air Conditioning & Plumbing is not responsible for pre-existing electrical issues including inadequate service capacity, improper wiring, code violations, or electrical failures unrelated to our work. If electrical deficiencies are discovered during installation, work may be suspended pending correction by a licensed electrician at customer expense.

29. Gas Line Work, Testing & Safety

Gas line work performed under our HVAC license includes connections to existing gas supply lines, installation of shutoff valves, and pressure testing as required for equipment installation. Major gas line installation, repair, or relocation requires additional permits and may require coordination with the local gas utility company. Weiss Air Conditioning & Plumbing is not responsible for pre-existing gas line issues, undersized gas supply, or code violations in existing installations. Any gas leaks detected during service will be reported immediately, and gas supply may be shut off for safety. Restoration of gas service may require utility company inspection and approval. Customers are responsible for ensuring adequate gas pressure and supply capacity for installed equipment.

PLUMBING-SPECIFIC TERMS

30. Plumbing Licensing & Compliance

All plumbing work requiring a license is performed by or under the supervision of a licensed plumber pursuant to Texas Plumbing License Law under Master Plumbing License MPL46433. Permit and inspection requirements will follow local jurisdiction rules.

31. Plumbing Services Scope

Plumbing services may include diagnostics, fixture installation, water heater replacement, drain cleaning, and leak repairs, all performed under the supervision of a licensed Master Plumber in compliance with Texas regulations.

32. Water Heater Installation Requirements

Water heater installations must comply with current plumbing codes and may require expansion tanks, pressure relief valve replacement, drain pan installation, seismic straps (where required), gas line upgrades, electrical upgrades, or venting modifications. These code-required upgrades are additional costs and will be included in the estimate. Weiss Air Conditioning & Plumbing is not responsible for damage caused by thermal expansion, excessive water pressure, or failure of existing plumbing components. Customers are responsible for testing pressure relief valves and maintaining the water heater per manufacturer guidelines. Water heater warranties are manufacturer warranties only; labor is not covered after our standard warranty period.

33. Sewer & Drain Limitations

Drain and sewer services are limited to visible and accessible piping. No guarantee is made that all obstructions will be resolved. Conditions such as collapsed lines, root intrusion, offsets, or hidden defects may require additional services, including camera inspections.

34. Sewer Camera Inspection & Hydro-Jetting

Video camera inspections of sewer and drain lines are performed to diagnose blockages, identify pipe conditions, and locate problem areas. Camera inspections cannot access all areas of piping and are limited by line size, configuration, and blockage severity. Inspection fees are separate from clearing or repair work. Hydro-jetting services use high-pressure water to clear blockages and clean pipe walls; this service is only appropriate for pipes in good structural condition. Hydro-jetting is not recommended for pipes that are collapsed, severely corroded, have known breaks, or are over 50 years old without prior camera inspection. Weiss Air Conditioning & Plumbing is not responsible for damage to pipes that fail during hydro-jetting due to pre-existing deterioration.

35. Underground Plumbing & Excavation

Underground plumbing repairs require excavation and restoration of landscaping, hardscaping, concrete, or paving. Excavation is performed to the minimum extent necessary to access and repair pipes. Restoration is limited to backfilling and basic grading unless specifically included in the written scope of work. Replacement of sod, landscaping, decorative surfaces, irrigation systems, or permanent structures is the customer’s responsibility unless contracted separately. The customer is responsible for verifying and marking the location of underground utilities, septic systems, irrigation lines, and other buried infrastructure prior to excavation. Weiss Air Conditioning & Plumbing will call 811 for public utility location but is not responsible for damage to private utilities, unlicensed installations, or improperly marked lines.

36. Water Damage & Leak Disclaimer

Weiss Air Conditioning & Plumbing is not responsible for damage caused by pre-existing plumbing conditions or future failures unrelated to performed work. The customer is responsible for monitoring systems after service and shutting off water if necessary.

37. Water Quality & Pressure

Weiss Air Conditioning & Plumbing is not responsible for damage caused by poor water quality, corrosion, or excessive water pressure. Pressure-regulating valves and expansion tanks are recommended where applicable.

38. Water Shut-Off Valve Responsibility

Customers are responsible for knowing the location of and maintaining their main water shut-off valve and individual fixture shut-off valves in working condition. Weiss Air Conditioning & Plumbing is not responsible for damage occurring because the customer was unable to shut off water in an emergency. If shut-off valves fail during service, replacement is charged separately. Seized or inoperable shut-off valves may require water service disconnection by the utility company to safely perform plumbing work.

39. Backflow Prevention & Testing

Backflow prevention devices required by local codes or water utilities must be installed by a licensed plumber and tested annually by a certified backflow tester. Initial installation includes the device and initial test; annual re-testing is the customer’s responsibility and is available for an additional fee. Failure to maintain and test backflow devices may result in water service disconnection by the utility company. Weiss Air Conditioning & Plumbing is not responsible for utility enforcement actions or fines related to backflow compliance.

CODE COMPLIANCE & PERMITS

40. Code Compliance & Permits

Services are performed based on visible and accessible conditions. Weiss Air Conditioning & Plumbing is not responsible for identifying or correcting pre-existing code violations unless specifically included in writing. Permit fees, inspections, and third-party requirements are the customer’s responsibility unless otherwise stated.

41. Prior Work & Pre-Existing Conditions

Weiss Air Conditioning & Plumbing is not responsible for defects, code violations, improper installations, or workmanship issues resulting from work performed by others. We may discover unpermitted work, code violations, safety hazards, or improper installations during service. Customers will be notified of significant issues, but correction of pre-existing problems is not included in the original scope of work unless specifically agreed in writing. Weiss Air Conditioning & Plumbing reserves the right to refuse to connect new equipment to systems that do not meet current code or safety standards until deficiencies are corrected.

HAZARDOUS MATERIALS

42. Lead-Based Paint Disclosure (Pre-1978 Properties)

For properties constructed prior to 1978, customers acknowledge receiving information about potential lead-based paint hazards. HVAC and plumbing work may disturb painted surfaces. Weiss Air Conditioning & Plumbing is not a certified lead inspector or risk assessor and makes no representations regarding the presence or absence of lead-based paint. Customers concerned about lead exposure should contact a certified lead professional before authorizing work that disturbs painted surfaces.

43. Lead Paint & Asbestos Disclaimer

Properties built before 1978 may contain lead paint; properties built before 1990 may contain asbestos in pipe insulation, ductwork, flooring, or ceiling materials. Weiss Air Conditioning & Plumbing is not licensed for lead or asbestos identification, testing, or remediation. Work may require disturbing surfaces that contain these materials. Customers are advised to have properties tested by qualified professionals if concerned about lead or asbestos exposure. By authorizing work, the customer acknowledges awareness of potential presence of these materials and releases Weiss Air Conditioning & Plumbing from liability related to their disturbance during normal scope of work.

INSURANCE & LIABILITY

44. Insurance, Claims & Customer Responsibility

Customers are encouraged to review their homeowners or property insurance policies to understand coverage for HVAC and plumbing systems, equipment failures, and water damage. Weiss Air Conditioning & Plumbing is not a party to insurance claims and does not guarantee coverage or reimbursement. Customers are responsible for filing claims, providing documentation, and working directly with insurance adjusters. We may provide invoices, photos, and technical information to support legitimate claims, but we do not complete insurance forms, provide estimates specifically for insurance purposes without payment, or negotiate directly with insurers. Insurance payments must be endorsed to the customer or paid directly to Weiss Air Conditioning & Plumbing; we do not accept assignment of insurance proceeds without prior written agreement.

45. Limitation of Liability

To the fullest extent permitted by law, Weiss Air Conditioning & Plumbing shall not be liable for indirect, incidental, or consequential damages, including loss of use, loss of comfort, loss of revenue, or inconvenience.

MAINTENANCE PLANS

46. Maintenance Plans

Maintenance plans include two seasonal visits per year unless otherwise stated. Missed visits may roll over for up to 12 months, after which they are forfeited. Early cancellation may result in prorated charges or recovery of discounts previously applied. Maintenance does not guarantee system performance or prevent future failures.

47. Service Plan Transferability & Terms

Prepaid maintenance plans are property-specific and may transfer to new owners upon property sale if requested in writing within 30 days of closing and subject to a transfer fee. The new owner must agree to these Terms & Conditions. Service plans do not guarantee system performance, prevent future failures, or cover repair costs beyond plan inclusions. Plans renew annually at then-current rates unless canceled in writing 30 days before renewal. Early cancellation results in loss of unused visits and may require repayment of discounts received on services performed at plan pricing.

BUSINESS OPERATIONS & SUBCONTRACTING

48. Use of Subcontractors

Weiss Air Conditioning & Plumbing reserves the right to use qualified, licensed subcontractors to perform work under the supervision and quality standards of Weiss Air Conditioning & Plumbing. All subcontracted work is performed to the same standards and is covered by the same warranties and terms as work performed by direct employees. The customer will be notified if subcontractors will be used for major installations or specialty work.

49. Force Majeure

Weiss Air Conditioning & Plumbing is not responsible for delays or failures caused by events beyond its control, including acts of God, weather, labor shortages, supply-chain disruptions, utility interruptions, manufacturer delays, or governmental actions.

50. Termination / Stop-Work Rights

Weiss Air Conditioning & Plumbing may immediately suspend or terminate services for non-payment, unsafe conditions, refusal of access, or other material violations of these Terms & Conditions. All charges incurred up to the date of suspension or termination remain due and payable. Any equipment not fully paid for may be removed to the extent permitted by law.

COMMUNICATIONS & PRIVACY

51. Communications, Documentation & Recordings

The customer consents to receive communications via phone, text, email, and electronic systems. Calls may be recorded. Weiss Air Conditioning & Plumbing may take photos or videos of work areas for documentation, quality control, training, or dispute resolution purposes. Digital approvals and electronic signatures are legally binding.

52. Privacy, Data Protection & Communications Consent

Weiss Air Conditioning & Plumbing collects and maintains customer information including contact details, service history, payment information, and property details to provide services and improve customer experience. This information is stored securely and is not sold or shared with third parties except as required for business operations (e.g., payment processing, financing applications). By providing a phone number or email address, the customer consents to receive service-related communications, appointment reminders, invoices, and promotional offers via phone calls (including potential use of autodialed or prerecorded calls), text messages (SMS), and email in accordance with the Telephone Consumer Protection Act (TCPA). Message and data rates may apply. Customers may opt out of promotional communications at any time by contacting us directly or following unsubscribe instructions. Transactional messages will continue as needed for active service relationships. Credit card information is processed through secure, PCI-compliant systems and is not stored locally. Customers have the right to request access to, correction of, or deletion of their personal information, subject to record-retention requirements.

53. TCPA Compliance & Marketing Communications

By providing contact information and engaging our services, you authorize Weiss Air Conditioning & Plumbing to contact you via phone calls (including potential use of autodialed or prerecorded calls), text messages (SMS), and email for transactional communications (appointment confirmations, invoices, service updates) and marketing communications (promotions, seasonal reminders, service plan renewals). Consent is not a condition of purchase. You may opt out of marketing communications at any time by replying STOP to text messages, clicking unsubscribe in emails, or contacting our office directly. Transactional messages will continue as needed for active service relationships. Message and data rates may apply.

54. Referral & Review Programs

Referral rewards, discounts, or incentives provided through referral or review programs are subject to program terms and conditions which may change or be discontinued at any time. Rewards are typically issued after referred customer completes paid service. We reserve the right to disqualify referrals that do not meet program criteria or appear fraudulent. By leaving reviews, customers grant Weiss Air Conditioning & Plumbing permission to display testimonials and feedback on our website, social media, and marketing materials.

LEGAL & DISPUTE RESOLUTION

55. Arbitration & Mediation Agreement

Prior to initiating legal action, the parties agree to attempt good-faith mediation in Montgomery County, Texas. If mediation is unsuccessful, disputes shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) under its applicable rules. Arbitration shall be conducted by a single arbitrator experienced in construction or home service matters. The parties waive the right to a jury trial and agree that claims may not be brought as class actions. Each party shall bear its own attorneys’ fees unless otherwise awarded by the arbitrator.

56. Mechanic’s & Constitutional Lien Notice (Texas)

NOTICE: Any contractor or supplier who furnishes labor or materials for the improvement of real property may have lien rights under Texas law if not paid. Weiss Air Conditioning & Plumbing reserves all lien rights available under the Texas Property Code, including constitutional and statutory mechanic’s liens, to secure payment for labor and materials provided.

57. Governing Law & Venue

This agreement is governed by the laws of the State of Texas. Venue for any dispute shall be Montgomery County, Texas.

58. Assignment & Severability

This agreement may not be assigned without written consent. If any provision is found unenforceable, the remaining provisions shall remain in full force and effect.

59. Entire Agreement

These Terms & Conditions, together with the approved estimate or service agreement, represent the entire agreement between the parties and supersede all prior communications. Modifications must be in writing and approved by both parties.

60. Acceptance & Authorization

By approving an estimate, signing electronically, scheduling service, or allowing work to begin, the customer acknowledges they have read, understand, and agree to these Terms & Conditions.
